“BIG FISH” SECOND CHANCE PROMOTION
APRIL 22, 2014

I. Name of Promotion

The name of this promotion will be the “BIG FISH” Second Chance Promotion.

II. Definitions

A. “Wealthy Wally” means the Minnesota State Lottery Scratch Game #954.

B. “BIG   FISH   Second   Chance   Promotion   Drawings”   means the   drawings conducted by the Lottery in conjunction with the “BIG FISH” Second Chance Promotion.

III. Duration of the Promotion

The “BIG FISH” Second Chance Promotion will begin on April 22, 2014, and conclude on October 28, 2014.

IV. Eligibility for the “BIG FISH” Second Chance Promotion Drawings

A. To enter the “BIG FISH” Second Chance Promotion contest, a person must: 1) log in to the Minnesota State Lottery’s players club website at www.mnlottery.com,  and,  while  logged  in,  complete  an  entry  form  which includes all required information, and 2) enter the 10-digit validation number that appears under the latex of a non-winning “Wealthy Wally” Scratch Game Ticket; or 3) by mailing non-winning “Wealthy Wally” Scratch Tickets to the Lottery.

B. If entering by  mail,  the  “Wealthy Wally”  non-winning  Scratch  Game  Ticket submitted must have the person’s first and last name, complete address and phone number (including area code) legibly completed on the Ticket, must have the proper postage affixed to the back of the Ticket, and must be delivered through the U.S. mail to the specific entry address listed on the back of the ticket.  No drop-off or special delivery entries will be accepted.  Tickets mailed inside an envelope will be ineligible.   A non-winning “Wealthy Wally” Scratch Game Ticket that is mailed must be received by the Lottery between April 22, 2014, and 5:00 p.m. CDT on October 28, 2014.   A “Wealthy Wally” Scratch Game Ticket that is entered via the Internet must be received by the Lottery between 5:00 a.m. CDT on April 22, 2014, and 11:59:59 p.m. CDT on October 28, 2014.

C. Entries mailed to the Lottery through U.S. mail that have also been entered via the Internet will be considered invalid if the entries are made using the same non-winning “Wealthy Wally” Scratch Game Ticket.  Entries completed via the   Internet that have also been mailed to the Lottery will be considered invalid if made using the same non-winning “Wealthy Wally” Scratch Game Ticket.

D. Facsimile or photocopied non-winning “Wealthy Wally” Scratch Game Tickets are not permitted.

E. Each “Wealthy Wally” Scratch Game Ticket entered will receive one (1) entry.

F. The  submission  of  a  winning  “Wealthy  Wally”  Scratch  Game  Ticket  will invalidate that entry.

G. Employees (including immediate  family  members  residing  in   the   same household) of the Minnesota State Lottery, Digiknow Inc., Clockwork Active Media Systems, LLC, and any other company that is not eligible to receive a prize from the Lottery under Minnesota law or pursuant to a contract with the Lottery are ineligible for any of the “BIG FISH” Second Chance Promotion Drawings.

H. The person who submits an entry must be 18 years of age or older.

I. The Minnesota State Lottery is not responsible for delayed, lost or misdirected electronic submissions made through the Internet or for delayed, lost or misdirected submissions made through the U.S. mail.

J. A person may enter more than once; however, the player may only use one (1) unique non-winning  “Wealthy  Wally”  Scratch   Game  Ticket  number  per entry.  Multiple entries using the same “Wealthy Wally” Scratch Game Ticket number   and   entries   made   via   automated   computer   scripts   or   other programming techniques will be disqualified.

K. A person may only be selected once in each of the five (5) “BIG FISH” Second Chance Promotion Drawings.

L.       A player who uses a non-winning “Wealthy Wally” Scratch Game Ticket as an entry  in  the  “BIG  FISH”  Second  Chance  Promotion  Drawings  that  has previously been used in any other Minnesota State Lottery second chance promotion or contest will be considered ineligible.

M. By participating, players agree to these official rules and to the decisions of the Minnesota State Lottery which will be final and binding in all respects.

N.       An entry will be considered invalid if it does not meet all of the requirements for eligibility stated in this section.

O.      If more than one (1) name appears on the back of a non-winning “Wealthy Wally” Scratch Game Ticket and the entry is selected for a prize in the “BIG FISH” Second Chance Promotion Drawings, the Lottery will randomly select the person who will receive the prize from among those names that appear on the back of the Ticket.  

V. “BIG FISH” Second Chance Promotion Drawings

A. The Minnesota State Lottery will conduct a total of five (5) “BIG FISH” Second Chance Promotion Drawings, whether entered via the Internet or by mail.  The eligibility and schedule for each Drawing are set forth in the chart below.

B. The Minnesota State Lottery will select one (1) entry in each of the five (5) “BIG FISH” Second Chance drawings listed to win one (1) $1,000.00 cash prize.  A total of five (5) $1,000.00 cash prizes will be awarded.   The Lottery will then draw  four  (4)  entries  in  each  of  the  five  (5)  “BIG  FISH”  Second  Chance drawings listed to win a $500.00 cash prize.  A total of twenty (20) $500.00 cash prizes will be awarded. One (1) entry will be selected in drawing #5 for a $5,000 cash prize.

C. The odds of being selected in any drawing are dependent on the number of entries received for that drawing.   D. A list of all “BIG FISH” Second Chance Promotion Drawing winners will be posted on the WINNERS page of the  www.mnlottery.com website following each drawing and after winners have been verified.

E. Each  person  entering  any  of  the  “BIG  FISH”  Second  Chance  Promotion Drawings and winning a prize from the promotion consents to the use of his or her name and/or likeness for advertising, trade or promotional purposes without further compensation.

F. The Lottery will, by use of mechanical or other devices, randomly determine which of the entries submitted are selected.

G. A prize won in any of the “BIG FISH” Second Chance Promotion Drawings may not be assigned or transferred to another person. Federal, state or local taxes on any prize are the sole responsibility of the winner.   All applicable federal, state or local laws apply.  The Lottery reserves the right to substitute any prize awarded in the “BIG FISH” Second Chance Promotion Drawings based on availability.

H. The Lottery provides no warranties, guarantees or representations of any kind, express or implied, arising by law or otherwise, including, without any limitation, any implied warranty of fitness for a particular purpose or any implied warranty arising from course of performance, course of dealing usage of trade in relation to any item included in a prize won in a “BIG FISH” Second Chance Promotion Drawing.

VI. Claiming a Prize in the “BIG FISH” Second Chance Promotion

A. A person whose entry was selected in a “BIG FISH” Second Chance Grand Prize Promotion Drawing for a prize of over $600 must fill out a claim form and submit it to the Minnesota State Lottery within thirty (30) days after the person is notified that they have been  selected  in  a  “BIG  FISH”  Drawing.    If  the  claim  form  is  not submitted within the required time period, any prize won during the “BIG FISH” Second Chance Promotion in which the player is eligible is forfeited by the player and the player has no further right to the prize and the Minnesota State Lottery may award the prize to another player.  If the person is delinquent in the payment of state taxes or owes a debt as defined in Minnesota Statutes §270A.03, Subdivision 5, the amount due will be deducted from the value of the prize. If the claim is validated by the Lottery, the prize will be awarded to the player.  In the event that the claim is not validated by the Lottery, the claim shall be denied and the player shall be notified immediately.

B. The twenty-six (26) people whose entries were selected in the “BIG FISH” Second Chance Promotion Drawings will be mailed their cash prizes to the address provided.   VII. Emergency Termination of the “BIG FISH” Second Chance Promotion.

If, for any reason, all or any part of the “BIG FISH” Second Chance Promotion is not capable of running as planned due to, without limitation, errors in these official rules or advertising for this promotion, tampering, unauthorized intervention, fraud, technical failures, human error or any other cause beyond the control of the Minnesota State Lottery that, in the sole judgment of the Minnesota State Lottery, could corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Minnesota State Lottery reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the promotion.

VIII. Governing Law

By submitting an entry into the “BIG FISH” Second Chance Promotion, the person agrees to comply with and abide by the game procedures for the “BIG FISH” Second Chance Promotion; Minnesota Statutes, Chapter 349A (the State Lottery Law); Minnesota Rules, Chapter 7857 (the Lottery's Prize Payment Rules); and all final decisions of the Director of the Lottery.  All applicable federal, state or local laws apply. Second chance entry offer void where prohibited by law.
